- Remember to confirm your reservation within 14 days of
departure.
- Deposits are Non-Refundable but may be applied to another
trip (minus $100 service charge). The transferred
deposit/trip charge must be utilized within 90 days, after
which the deposit/trip charge will be forfeited.
- Cancellations / transfers must be made in writing and are
effective upon date received.
- Balance is due at or prior to departure payable to
AdventureBus in the form of a Money Order, Countersigned
Travelers Checks, Cash or Credit Card. It is not required, but
recommended that passengers be insured against sickness,
loss of baggage, and cancellation or delay of trip.
- While a passenger on AdventureBus, you are covered under
our commercial passenger vehicle insurance. You are not
covered anytime you are off the bus.
I have read and agree to the deposit and reservation policies
above. I have read and agree to sign the assumption of risk,
release, and binding arbitration agreement form on the reverse
of this page. I understand that the company reserves the right
to refuse service to any person at any time prior to or during
the trip if, in AdventureBus' opinion, the applicant or
passenger is not compatible with the other members of the trip,
with out compensation other than that of the unused portion of
their food fund. I understand that the final decisions on the
itinerary are at the discretion of the driver. I understand it
is my sole responsibility to catch up with the trip in the event
that I am left behind I understand that AdventureBus reserves
the right to cancel any trip for any reason without compensation
other than refund of fare, rental fee and food fund paid. I
understand that AdventureBus reserves the right, but is not
obliged, to substitute a similar vehicle. I understand that fine
print is an annoying but necessary evil in order to attain some
of the good things in life. |

ASSUMPTION
OF RISK, RELEASE AND BINDING ARBITRATION AGREEMENT
AdventureBus, INC., ADVENTUREBUS, INC., their employees,
shareholders, subsidiaries, affiliates, officers, directors,
successors, agents, and assigns (collectively ADVENTUREBUS) does
not own or operate any entity which is to, or does provide goods
or services for your trip including, for example, lodging
facilities, transportation companies, food service providers,
equipment suppliers, babysitters or daycare providers, etc. As a
result, ADVENTUREBUS is not liable for any negligent or willful
act or failure to act of any such person, or of any other third
party.
In addition, I acknowledge that I have voluntarily applied to
participate in the trip designated on this application (or a
trip to which I may subsequently transfer). I am voluntarily
participating in this trip with the knowledge of the numerous
risks and dangers involved including but not limited to:
negligence on the part of ADVENTUREBUS; physical exertion for
which I am not prepared; forces of nature; transportation
failures whether by plane, train, auto, boat, canoe, kayak,
bicycle, ski, horseback or other animal, by foot, or by any
other conveyance; consumption of alcoholic beverages; risks
associated with food or impure water; civil unrest; terrorism;
criminal activity; dangers associated with wild or other
animals; breakdown or failure of bicycles or other equipment;
high altitude; accident or illness without access to means of
rapid evacuation or availability of medical supplies or
services; the adequacy of medical attention once provided; and
stolen, lost, or misplaced luggage or property. I acknowledge
that the enjoyment and excitement of adventure travel is derived
in part from the inherent risks incurred by travel and activity
beyond the accepted safety of life at home or work and that
these inherent risks contribute to such enjoyment and
excitement, being a reason for my participation. I HEREBY AGREE
TO BE RESPONSIBLE FOR MY OWN WELFARE AND ACCEPT ANY AND ALL
RISKS OF DELAY, UNANTICIPATED EVENTS, INCONVENIENCE, ILLNESS,
INJURY, EMOTIONAL TRAUMA OR DEATH.
I acknowledge that the cost of all ADVENTUREBUS trips is based
upon trip participants executing this Release of Liability,
Assumption of All Risk, and Arbitration Agreement. Therefore, as
lawful consideration for being permitted to participate on such
trip(s), I hereby RELEASE AND DISCHARGE FOREVER ADVENTUREBUS
FROM AND AGAINST ANY AND ALL LIABILITY ARISING FROM MY
PARTICIPATION IN THE TRIP. I agree that this release shall be
legally binding upon me personally, all members of my family and
all minors traveling with me, my and their heirs, successors,
assigns, and legal representatives, it being my intention fully
to assume all the risks associated with this trip and to release
ADVENTUREBUS from any and all liabilities to the maximum extent
permitted by law.
I understand that ADVENTUREBUS reserves the right to take
photographic or film records of any of its trips and hereby
agree that ADVENTUREBUS may use any such photographic or film
records for promotional and/or commercial purposes, as well as
approve such use by third parties with whom ADVENTUREBUS may
engage in joint marketing, without any remuneration to me. I
hereby assign all right, title, and interest I may have in or to
any and all media in which my name or likeness might be used by
ADVENTUREBUS.
I understand that ADVENTUREBUS reserves the right to refuse as a
trip participant, or remove from a trip, any person it judges to
be incapable of meeting the rigors and requirements of
participating in the activities, or who it determines to detract
from the enjoyment of the trip by others. I agree to follow all
written and verbal rules of safety presented to me by
ADVENTUREBUS.
ASSUMPTION OF RISK
I am not a minor and I understand that by being a passenger of
ADVENTUREBUS (ADVENTUREBUS) that:
A. I will have the opportunity to participate in various
activities, including but not limited to hiking, swimming,
snorkeling, windsurfing, rafting, boating, cave exploration,
kayaking, soaking in hot springs, and engaging in other
activities in public parklands and in privately-owned facilities
such as restaurants, bars, stores, and recreation areas. I
further understand that by participating in any of these
activities, I may be subjected to a variety of hazards and
risks, foreseen or unforeseen, which may cause me to suffer
property damage, injury, or death ("DAMAGES"). I know
that these DAMAGES can occur due to natural causes, the active
or passive negligence of ADVENTUREBUS, its employees and agents,
or the negligent and intentional acts of third parties and/or
fellow passengers. I further understand that while on the
ADVENTUREBUS there will be times when access to rescue or
medical facilities or expertise may be several hours or even
days away from the location where these DAMAGES may occur. I
understand that being exposed to such DAMAGES, risks and hazards
are inherent in participating in ADVENTUREBUS Adventure Travel
and I understand that I should therefore exercise extra care for
my own person. I understand the potential for these DAMAGES to
occur, that those hazards and risks associated with ADVENTUREBUS
exist, and notwithstanding these factors I choose to take this
ADVENTUREBUS journey, agree to pay the required costs therefore
and voluntarily assume the risks of such DAMAGES occurring while
I am on my ADVENTUREBUS journey.
B. ADVENTUREBUS may at times deliver passengers to various third
parties who will conduct, supervise, guide, or instruct
passengers in various sporting or recreational activities, or
conduct entire tours including but not limited to, those
activities listed above in section A. ADVENTUREBUS assumes no
duty to certify, monitor or verify the qualifications of any
third parties involved in these activities. Passengers' concerns
regarding the qualifications of any third parties conducting or
supervising these activities should be directed to the third
parties and passenger agrees to release, indemnify and hold
harmless ADVENTUREBUS for liability for DAMAGES arising out of
the negligence of such third parties.
C. I have chosen to be a passenger on an unconventional touring
vehicle that differs in design from ordinary commercial buses
used for regular transportation or touring purposes. Since the
vehicle in which I will be traveling is not a conventional tour
bus and therefore involves unique risks of DAMAGES, I understand
the need for all passengers to exercise particular caution when
on the bus, and especially while moving around the interior of
the vehicle while the vehicle is in transit. I voluntarily
assume the risks of any and all DAMAGES I may incur on
ADVENTUREBUS vehicles unless such DAMAGES are directly related
to the negligent operation of the vehicle by ADVENTUREBUS
employees.
D. In the event that I choose to quit or depart from my
ADVENTUREBUS tour prior to the completion of the tour as
scheduled, I understand the risk inherent in doing so, and I
agree to release, indemnify and hold harmless ADVENTUREBUS, its
officers, directors, agents and employees of any liability for
DAMAGES arising out of, or occurring after, my departure from
the tour. I also understand that by quitting or departing from
the tour I will have forfeited and relinquished any remaining
value in the ticket purchased for the tour and waive any and all
claims for reimbursement from the ADVENTUREBUS.
RELEASE
In consideration for being accepted by ADVENTUREBUS [or any of
its affiliated entities] to take a ADVENTUREBUS journey, I
hereby agree to hold ADVENTUREBUS, [its affiliated entities],
owners, agents, employees and contractors harmless from any and
all liability, action, causes of action, debts, claims and
demands of every kind and nature whatsoever which I now have or
which may arise from or in connection with my ADVENTUREBUS
journey. The terms of this Agreement shall also serve as release
and assumption of risk from my heirs, executors and
administrators and for all members of my family. I, my heirs,
distributees, guardians, and legal representatives hereby agree
to hold harmless, and not make any claim against, sue, or attach
the property of ADVENTUREBUS, [its affiliated entities], its
owners, agents, employees or contractors for any injury or
damage I might suffer due to the acts of omissions, including
negligent acts of omissions, of any employee, agent, contractor
or owner of ADVENTUREBUS [or any of its affiliated entities].
The undersigned further expressly agrees that this RELEASE and
ASSUMPTION OF RISK AGREEMENT is intended to be as broad as
permitted under California law and that if any portion of
thereof is held invalid, it is agreed that all other portions
shall continue in full legal force and effect.
BINDING ARBITRATION
Any controversy or claim arising out of or relating to any
DAMAGES I may incur, or concerning the Agreement, or to the
making, performance or interpretation thereof, shall be settled
by binding arbitration in Utah, in
accordance with the rules of the American Arbitration
Association which then exist. I understand that binding
arbitration may deprive me of various rights that I might
otherwise have in a legal action, including, without limitation,
the right to a jury trial, the right to appeal, and full
discovery rights. Judgement on the arbitration award may be
entered in any court having jurisdiction over the subject matter
of the controversy. I further agree to pay half of any costs to
third parties, including arbitrator(s), in an arbitration
proceeding commenced and conducted pursuant to this agreement.
I HAVE READ THE ABOVE ASSUMPTION OF RISK, RELEASE AND BINDING
ARBITRATION AGREEMENT AND VOLUNTARILY AGREE TO SIGN THIS
DOCUMENT. No oral representations, statements or inducements,
apart from this written agreement have been made and the
undersigned acknowledges that the terms of this agreement cannot
be altered or waived by any ADVENTUREBUS employee or agent
except in writing.
